1. SPONSOR: The sponsor of the New Boston Creative Group Survey Giveaway (the "Promotion") is New Boston Creative Group LLC in respect of all entrants (from here on referred to as "Sponsor").
2. ELIGIBILITY: This Promotion is open only to those who sign up at the sweepstakes landing page and who are 18 years of age or older as of the date of entry. The Promotion is only open to legal residents of the United States and is void where prohibited by law. Employees of New Boston Creative Group LLC, its affiliates, subsidiaries, advertising and Promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion. Employees of the K-State Alumni Association, its affiliates, subsidiaries, advertising and Promotion agencies, and suppliers (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
3. PROMOTION TIMING/DESCRIPTION: Entries will be accepted online starting Oct. 17, 2023 and ending Dec. 8, 2023 (or before then if the survey is closed early due to reaching the maximum number of completed surveys).   
4. HOW TO ENTER: The Promotion must be entered by submitting an entry using the online form provided. The entry must fulfill all Promotion requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of New Boston Creative Group LLC. You may enter only once. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of New Boston Creative Group LLC.
5. PRIZES: Five (5) Winners of the Promotion (the “Winners”) will receive a gift card valued at $200. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by New Boston Creative Group LLC. No cash or other prize substitution shall be permitted except at New Boston Creative Group LLC's discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winners is permitted. Acceptance of prize constitutes permission for New Boston Creative Group LLC to use Winners' names, likenesses, and entries for purposes of advertising and trade without further compensation unless prohibited by law.
6. WINNER DETERMINATION AND NOTIFICATION: Five (5) Winners will be selected by a random drawing under the supervision of New Boston Creative Group LLC. Winners will be notified by email following selection of the Winners. New Boston Creative Group LLC shall have no liability for Winners' failure to receive notices due to spam, junk e-mail, or other security settings or for Winners' provision of incorrect or otherwise non-functioning contact information. If Winners cannot be contacted, are ineligible, or fail to claim the prize within five (5) days from the time award notification was sent, the prize may be forfeited and an alternate Winner selected. Receipt by Winners of the prize offered in this Promotion is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT NEW BOSTON CREATIVE GROUP'S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE PROMOTION, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
7. ODDS OF WINNING: The odds of winning depend on the number of eligible entries received.
8. GENERAL TERMS & CONDITIONS: New Boston Creative Group LLC reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond New Boston Creative Group's control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. In such case, New Boston Creative Group LLC may select Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by New Boston Creative Group LLC. New Boston Creative Group LLC reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions. New Boston Creative Group LLC has the right, in its sole discretion, to maintain the integrity of the Promotion, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such an attempt be made, New Boston Creative Group LLC reserves the right to seek damages to the fullest extent permitted by law.
9. LIMITATION OF LIABILITY: By entering, you agree to release and hold harmless New Boston Creative Group LLC and its subsidiaries, affiliates, advertising and Promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
10. PUBLICITY GRANT: By entering, you understand and agree that New Boston Creative Group LLC, anyone acting on behalf of New Boston Creative Group LLC, has permission (except where prohibited by law) to use any winner’s name, likeness, prize won, hometown, and/or comments about winning for purposes of online posting, advertising, promotion, and publicity relating to the Promotion, and in any and all media, now or hereafter known, throughout the world for three (3) years from the date the winners were confirmed as winners without additional compensation, notification, permission, or approval.
11. WAIVER: Released Parties are not responsible for any technical, mechanical, or other error of any kind resulting from force majeure circumstances beyond their reasonable control and relating to or in connection with the Promotion, including, without limitation, errors which may occur in the administration of the Promotion, the processing of entries, the announcement of the prize, or any Promotion-related materials caused by such force majeure event. Participation in the Promotion by internet implies the acknowledgement by the Entrants of internet and IT systems' technical limits. As a consequence, Released Parties shall not be liable for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Promotion, incomplete, lost, late, stolen, damaged, inaccurate, misdirected, garbled, delayed, or undelivered entries, or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled, or delayed computer transmission, which may limit an individual’s ability to participate and/or the failure of any third party to comply with the instructions and proper administration of this Promotion. Sponsor reserves the right in its sole discretion, to disqualify any Entrant or Entry that is in violation of the Official Rules or to cancel, suspend or modify the Promotion, and disqualify any implicated Entrant(s), (and their entries) if any fraud, virus, actions by Entrants, technical or other error or problem of any kind, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Promotion. In the event of cancellation, Sponsor reserves the right, at its sole discretion, to select the potential winner in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation or to take any other action it deems equitable to fairly award any prize. CAUTION: Any attempt by an Entrant to deliberately damage any web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such Entrant to the fullest extent permitted by law, including criminal prosecution. Sponsor is not responsible in the event Sponsor is prevented from continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court or other cause not within Sponsor's control or concerns regarding the safety of any Entrant or winner, or otherwise.
12. DISPUTES: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND KANSAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Kansas having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Promotion). Participant further waives all rights to have damages multiplied or increased.

14. FACEBOOK AND META: The Promotion hosted by New Boston Creative Group LLC and is in no way sponsored, endorsed, administered by, or associated with Meta. You understand that you are providing your information to New Boston Creative Group LLC and not to Meta.
15. WINNERS LIST: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: New Boston Creative Group, 315 Houston St., Ste. E, Manhattan, KS 66502. Requests must be received no later than February 1, 2024 11:00 a.m. CST.
16. ADMINISTRATOR: The Administrator of the Promotion is New Boston Creative Group, 315 Houston St., Ste. E, Manhattan, KS 66502.
17. AGREEMENT TO RULES: By participating, the Contestant (“you”) agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of New Boston Creative Group LLC as final and binding as it relates to the content of this Promotion.
